This memorandum analyzes whether, in light of § 1312(d)(3)(D) of the Patient Protection and Affordable Care Act (PPACA),  whether the federal government is (1) required to pay a portion of the premiums for Members of Congress and congressional staff, similar to the Federal Employees Health Benefits Program (FEHBP), and (2) subject to the employer responsibility requirements under § 1513 of PPACA, as amended. it also discusses whether state and local governments can be subject to the employer responsibility requirements, and whether imposing these requirements on a state and local government would run afoul of the Tenth Amendment.
